This waiver and release of liability agreement (“Agreement”) is entered into between the "Host," and the "Guest", who agrees to the terms and conditions outlined below in exchange for the use of the BDSM equipment and facilities at 915 Paul Ave, Scranton, PA.

1. Assumption of Risk

The Guest acknowledges that the BDSM equipment provided, including but not limited to furniture, restraints, and other accessories, are designed for adult, consensual use only. By signing this waiver, the Guest understands and accepts that there are inherent risks involved in the use of such equipment, including but not limited to physical injury, psychological distress, or equipment failure.

The Guest voluntarily assumes all risks associated with the use of this equipment, whether known or unknown, and agrees to use the equipment responsibly and safely.

2. Release of Liability

The Guest hereby releases, waives, and discharges the Host, property owner, and any affiliated entities from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death resulting from the use or misuse of the BDSM equipment during their stay at the property.

This release includes, but is not limited to, injuries or damages caused by:

• The Guest's own actions or failure to follow instructions or proper usage guidelines,
• Accidents, equipment failure, or malfunction,
• Any other occurrence related to the use of BDSM equipment.

3. No Liability for Misuse

The Guest agrees to use the BDSM furniture and equipment only for its intended purposes, in accordance with safe, sane, and consensual (SSC) practices. The Guest further agrees that any misuse or failure to follow standard safety practices is at their own risk, and the Host shall bear no responsibility for any resulting harm.

4. Indemnification

The Guest agrees to indemnify, defend, and hold harmless the Host from any and all claims, actions, liabilities, damages, losses, or expenses (including attorney’s fees) that arise from the Guest’s use of the BDSM equipment, including any third-party claims related to the Guest’s use of the equipment.

5. Age Verification

The Guest affirms that they are at least 18 years of age and legally capable of entering into this Agreement. The Guest further acknowledges that all individuals using the BDSM equipment are 18 years of age or older.

6. Agreement to Terms

By booking this property, the Guest acknowledges that they have read and fully understand the terms and conditions outlined in this waiver and release of liability. The Guest agrees to comply with these terms and assumes full responsibility for any risks associated with the use of BDSM equipment.
